ShuferSal Deal Givat Shaul - Jerusalem

The following update regarding the status of ShuferSal Deal – Givat Shaul, Jerusalem, was released by Rabbi Yaakov Warhaftig Shlita, of Har Nof. It was Rav Warhaftig who provided me with the information appearing in the previous report, warning shoppers of possible kashrut hazards in various departments of the store.

Following my investigation with relevant kashrut officials, following is a report on the store’s kashrut status.

There is a mashgiach who comes in from time-to-time, responsible for the supermarket as per the Jerusalem Rabbinical Council Kashrut Department.

The products sold in the store’s bakery are from Gidron, which is under the supervision of the Holon Rabbinate and Chug Chatam Sofer Petach Tikvah.

From the information I have obtained, they are a “good level of kashrut”. The actual baking is done in ShuferSal, and the store’s Jerusalem Rabbinate mashgiach has undertaken responsibility for the products, although there is still no kashrut certificate attesting to this. Nevertheless, everything appears in order.

Fruits and Vegetables
All the fruits and vegetables are from the Katif Company, under the supervision of the Rishon L’Tzion Rabbinate, once again, there is no kashrut certificate attesting to this. This is because a local rabbinate of one city may not display a certificate in another city.

The Katif Company is under the supervision of Belz-Machzikei Hadas. To date, the certificate was only for certain items due to the heter mechira issue surrounding Shmitah. Now that this is behind us, the Belz certificate is all-inclusive.

Cheeses and Pickled Items (Chamutzim)
All the products arrive in sealed containers as is verified by the mashgiach. Once again, this department does not have a kashrut certificate. Some of the cheeses contain non chalav yisrael milk powder and some of the chamutzim are heter mechira.

It appears that in part, the reason there is no certificate from the Jerusalem Rabbinate is due to the ongoing battle being waged by the local Rabbanut against heter mechira items.

In Conclusion:
In our situation, despite the fact there is no kashrut certificate for this particular store, after probing the matter it appears one may purchase the ShuferSal Deal items. One should conduct oneself in accordance to one’s custom regarding heter mechira items and non chalav yisrael milk powder.

JKN Comment:
Not in any way chas v’sholom to contradict Rav Warhaftig Shlita, I would humbly point out that one should at the very least check with the store’s mashgiach before making purchases of the items mentioned since if there is no kashrut certificate, the store may make changes at any time, and the shopper would not be aware since there is no certificate to begin with regarding cheese, chamutzim and bakery items. The rabbinate cannot be held responsible, since there is no sign and therefore, officially, the store is not under its supervision.

I also feel shoppers should begin calling and faxing the Jerusalem Religious Council Kashrut Department and ShuferSal to complain. It think it is outrageous that a major supermarket [in Jerusalem] is permitted to operate without a kashrut certificate, compelling shoppers to rely on a mashgiach – while there is no documentation that he is responsible for the store.

Situations change and in this case, one has no way of knowing. The only kashrut certificate is for the produce, under the Belz hechsher, leaving shoppers to rely on a mashgiach today, but what about tomorrow?

Shopping ‘blindly’ is a recipe for buying something one may not necessarily want to use and that is simply an unacceptable practice.

לאחר בדיקה בין גורמי הכשרות הרלוונטיים לעניינו, הריני לתאר מצב הכשרות וההשגחה בשופר סל דיל.
כללית ישנו משגיח שאחראי מטעם המועצה הדתית ירושלים, כאשר הוא נכנס ויוצא, ואחראי על הסופרים.
במחלקת הבשר – ישנה תעודה מטעם רבנות ירושלים.
בקונדיטוריה – המוצרים הינם ממאפיית ‘גדרון’ שבהשגחת רבנות חולון וחוג חת”ם סופר פ”ת, ולפי העדויות שקיבלתי הם ברמת כשרות טובה. האפייה מתבצעת בשופר סל, ומשגיח החנות מטעם הרבנות לקח על עצמו להשגיח ולטפל – אמנם אין תעודה עדיין, אך נראה שהכול בסדר.
פירות וירקות –כל הפירות והירקות מגיעים מחברת קטיף, שמושגחת ע”י רבנות ראשון לציון וע”י, אף שאין תעודה על כך, כיוון שאסור לרבנות אחת לתת תעודה במקום של רבנות אחרת.
כמו כן חברת קטיף מושגחת גם ע”י בעלז התעודה של בעלז היתה עד עכשיו לא על כל הפירות כיון שחלק היה עדיין מהיתר המכירה, אך היום הם נתנו תעודה על הכל כיון שכבר אין פירות מהיתר המכירה בסופר .
החמוצים והגבינות, כולם באים מאריזות סגורות, ומשגיח החנות מוודא זאת, אך שוב אין תעודה על כך. בגבינות ישנן חלק שהן מאבקת חלב נוכרי, בחמוצים יש היתר מכירה.
מכל האמור, נראה שחלק מבעיית התעודה הירושלמית קשור למאבקה של המועצה הדתית כיום, כנגד ‘היתר המכירה’.

לסיכום:
במקרה שלנו, אף שאין תעודה מפורשת על החנות כולה, לאחר הבירור נראה שניתן לקנות ממוצרי השופר-סל דיל כולו. כמובן שכל אחד לפי הנהגתו הפרטית לגבי ‘היתר מכירה’ וחלב או אבקת חלב עכו”ם.
